Police Reports 

A formal document created by law enforcement officers to record details about an incident, crime, or investigation. It includes information such as the date, time, and location of the event, the individuals involved, and a summary of the facts. Police reports serve as official accounts that can be used for legal proceedings & provide a basis for further investigation. They are essential for maintaining accurate records and ensuring public safety, but only if they are factual!

Received by the Defense Prior to Trial March 7, 2016

September 3, 2015

This is the first version of the police report defense was provided.

Notice the phone number Kyle called from isn't documented on this report.

It appears in later versions of the report in 2023 & 2025. Why?

Strangely, it also has the time the initial call as 20:53 - 0:00. It is also missing the timeline that is present in the other versions.

October 13, 2015

An update was provided on 10/13 with some of the preliminary investigation.

In the sequence of events timeline transferred from the CAD system, the very first entry is the only one missing a time. Why? This is the initial call and is the one we have disputed, asked for clarification as to the time of the call, and have been ignored by the prosecutor since October 2024.

October 24, 2015

This was the last version of the report defense received prior to the March 2016 trial with the only additional supporting narrative on 10/24. It details that a field was searched for bullets, but only after being harvested. Yet, Kyle testifies that the field "had been taken off" on 9/2. It doesn't include the the seizure & analysis of Cullen's

girlfriends' phone. Defense only had access to that police report at trial, though the report was updated months prior (in Dec 2015 and Jan 2016).

This version of the police report is what the prosecution brought to

trial March 2016.

This gave defense no prior access to react, prepare, or gain access to the cell phone records that the prosecutor's office, as of July 2025, has still refused to provide.

June 28, 2023

In 2023, we received subpoena power after uncovering the undisclosed CI deal. We were once again provided with discovery. We received a variety

of new items that had been suppressed, but some discovery that had been previously provided,

was now missing. The suppressed information included new information that Kyle had called from his home phone number, despite testifying that the call was placed from his cell phone

while running, putting him over a mile away from the supposed crime scene. 

March 18, 2025

Knowing that we had received a variety of police reports with differing information, we requested the police report again. Ten years later, we were surprised to see that our report had grown from 12 pages to 25 & listed files/evidence related to the case, NEVER seen before!! Most interesting, it records two different calls from Kyle:

-"Phone call from Kyle reporting the incident"

AND

-"Original call from Kyle"

Call for Service Log

Although Henry County Sheriff & Napoleon City Police Departments used the same system, the 2 logs have a time difference causing Napoleon's calls to differ by
two hours from Henry County Sheriff's report. This does not match
Napoleon's report, nor their police reports.

Kyle's Calls

A key point mentioned above is Kyle's call.
Where did it originate from & what time did it actually come in?
We have received two different versions of the same call!
Henry County Sheriff Department documents the call was placed at 20:53,
however, their own system documents that the call took place at 20:37.


In 2015 in the original discovery, we received the call without a date or time stamp. In 2023 once granted subpoena power, we were given the calls and radio transmissions between the deputies, these had NEVER been seen or heard before! Included in this discovery was a version of Kyle's call that included a time stamp at 20:37. The call that we were given in 2015 from Kyle, is the ONLY call provided  without a time stamp.
